Bihar Electricity Regulatory Commission (Terms and Conditions of Intra-State Open Access) Regulations 2018

HIGHLIGHTS

Eligibility to seek Open Access (OA)	Generating companies, captive generating plants and consumers eligible against payment of requisite charges. Capacities of 1 MW and above are eligible provided the Commission relaxes the capacity norms, subject to feasibility. Limitation of 1 MW will not apply for power transmission to the place of its own use by a captive generator.
Criterion for Granting Open Access	Augmentation requirement of intra-state transmission system shall be duly considered before award of LTOA. No augmentation of the transmission system will be granted to MTOA or STOA. MTOA or STOA may be awarded if the resultant power flow can be accommodated in the existing transmission system or the transmission system under execution. Construction of dedicated transmission lines are not to be construed as augmentation of the transmission system.

Procedure and Charges for Long Term Open Access (LTOA)	Inter-state long term open access as per the Central Electricity Regulatory Commission (Grant of Connectivity, Long term Access and Medium-term Open Access in Inter-State Transmission and related matters) Regulations, 2009 or its statutory re-enactments, as amended from time to time. Intra-state long term open access - Where augmentation of transmission system is required, the applicant shall also have to bear the transmission charges for the same. Fresh application is required in case of change in location or change in quantum of power to be interchanged by more than 10 percent. Application accompanied by non-refundable fee and bank guarantee of Rs.10,000 per MW of power to be transmitted. Open access will be available no later than 5 days from the date of furnishing of agreements by the open access consumer. LTOA may be extended on a written request by the consumer submitted to the STU at least six months prior to such expiry.
Procedure and Charges for Medium Term Open Access (MTOA)	Inter-state medium term open access as per the Central Electricity Regulatory Commission (Grant of Connectivity, Long term Access and Medium-term Open Access in Inter-State Transmission and related matters) Regulations, 2009 or its statutory re-enactments, as amended from time to time. Fresh application is required in case of change in location or change in quantum of power to be interchanged by more than 10 percent. The start date of medium term open access shall not be earlier than 5 months and not later than 1 year from the last day of the month in which application has been made. Application shall be accompanied by a non-refundable application fee. MTOA may be extended on a written request by the consumer submitted to the nodal agency at least three months prior to such expiry.
Procedure and Charges for Short Term Open Access (STOA)	Inter-state short term open access as per Central Electricity Regulatory Commission (Open Access in Inter-State Transmission) Regulations, 2008, or its statutory re-enactments, as amended from time to time. Application seeking STOA up to four months. Separate application for each month and each transaction in a month. Application for STOA in any month may be up to the 15^th day of the preceding month. Application shall be accompanied by a non-refundable application fee. Application for day-ahead open access may be submitted 3 days prior to the date of scheduling but no later than 1300 hrs of the day immediately preceding the day of scheduling.

OTHER PROVISIONS

Allotment Priority	The allotment priority for open access in intra-state transmission system shall be as follows: Distribution licensee to have highest priority irrespective of term of open access. LTOA shall have priority next to the distribution licensee. MTOA shall have priority next to the LTOA consumers. STOA shall have priority next to the MTOA consumers. Allotment priority for STOA will depend on availability of capacity. Existing OA consumers to have higher priority than new OA consumers provided the existing OA consumer applies for renewal within the stipulated period prior to expiry of existing term of open access. If the capacity requirement of an applicant exceeds the capacity available and the applicant is unable to restrict its capacity requirement, then the next priority consumer is considered for connection.

Scheduling and Metering	Scheduling Inter-state transaction – as per Central Commission specifications. Intra-state transaction – as per the state grid code for consumers with load of 10 MW and above, and all generating stations irrespective of capacity. Intra-state transaction – no scheduling required for capacity less than 10 MW provided the generating station from which such consumer has contracted power is subject to scheduling. Metering Special energy meters at the point of injection and drawal to be installed by the STU of the DISCOM at the cost of the customer. All open access customers shall abide by the metering standards of CEA.

Imbalance and Reactive Energy Charges	Imbalance Energy Charges In case of deviation by open access consumers, the difference shall be settled at the rate determined by the Commission. Payment of imbalance charges will have to be made within 10 days of issue of statement. Delay in payment beyond 12 days from the date of issue of statement shall attract simple interest @ 0.04% for each day of delay. Reactive Energy Charges 4 paise/kVAR
